Drinking under the influence (DUI) is something that the majority of us, if asked, would say we would never do, that we are all responsible enough not to drive after drinking. The reality of this however is that this can’t always be avoided. If you were to attend a party and be even slightly over the legal limit and you get pulled over by the police you could possibly be arrested for drinking and driving. It is not something that you did intentionally, it was therefore not pre-meditated. In cases like this where drinking and driving is involved is when you need a DUI Lawyer.

It is commonly thought that if you are pulled over by a law enforcement officer but you are under the legal limit that you will be released and sent on your way. The truth, however, is somewhat different. If you have been drinking that day/evening the law enforcement officer will most likely be able to smell it on your breath and will automatically begin to start an investigation of you. You should therefore be aware that even if you are below the legal states blood alcohol limit (bac) limit you can still be arrested, charged and convicted.

One of the most important things you yourself can do to prevent being put in this position is to know your rights, to learn what IS the responsible way to ‘drink responsibly’. There are certain groups out there who wish to further lower the blood alcohol limits which may seem like a good idea but what it really means is that most of us who like to go out and have a drink without getting ‘drunk’ are being put in a position where this is no longer possible at all.

The legal limits change, a couple of years ago the legal limits were these: .10 – was considered drunken .08 was impaired. However, they have changed the goal posts and now .08 is drunk! So whatever is the limit for impaired. This lowering of the limit is going to cause a major effect, court rooms and jails are already overcrowded but because of this face having even more defendants and inmates filling their rooms and cells. And then of course it is us the tax payer who has to pay out for the DUI enforcement and prosecution costs, and is it really going to make a difference? Is all this just swings and roundabouts never actually getting anywhere but just making society worse in the long run?

There is a Video that has been made to educate people who drink on how to drink responsibly and without getting into any bad situations. The video DOES NOT enable people to drink and drive quite happily without being caught, this is actually pretty impossible, if you are over the limit and you get caught then that’s it, no video is going to help prevent that from happening. It is purely to help people to be more responsible and make the right decisions, thinking before acting. Of course there are many who truly believe that these things won’t happen to them, like they have some kind of protection field surrounding them, which of course they have not, the hospitals, and courts jails and sadly graveyards are testimony to that.

If you are indeed one of these people who continuously drink and drive then be aware that you WILL get caught, there are more police out there to do exactly that, it is purely and simply a question of WHEN. It is in your best interests to get as educated as you can and LISTEN to what is being said and act on it, you will be so much better off for it in the long run.

Another thing to consider is that the effects of alcohol vary from person to person, what is the rule for one may not and probably will not be the rule for another. There are many factors which are included such as weight, sex, age, the consumption of food and each person’s general metabolic rate. These all add to the way every person’s body reacts to alcohol being in their bloodstream.
